EB-2 Visa (Green Card) Requirements, Documentation & Application Process
Types of EB-2 Visas
- Professional Associates with Advanced Degrees: Individuals seeking work in
the U.S. that requires an advanced degree or equivalent.
- Exceptional Ability: Individuals demonstrating exceptional ability in
sciences, arts, business, etc.
- National Interest Waiver (NIW): Obtaining an EB-2 without employer
sponsorship based on national interest.
Application Procedure
- Employer's Role (Except NIW): Employers file Form I-140, Petition for Alien
Worker, on behalf of the applicant.
- Labour Certification (Except NIW): Employers must file a PERM application
demonstrating unavailability of U.S. workers.
- Ongoing Financial Capacity: Employers must prove the ability to pay the
proposed salary.
EB-2 Requirements & Documentation
Advanced Degree
- Official academic records showing U.S. advanced degree or equivalent.
- Alternatively, records showing a U.S. baccalaureate degree and five years of progressive
post-baccalaureate work experience.
Exceptional Ability
- Documentation proving at least three of seven criteria defined by USCIS.
- Must also meet Labour Certification criteria.
National Interest Waiver (NIW)
- Proposed project of national significance.
- Project's impact, feasibility, and benefits.
- Waiver of job offer and Labour Certification requirement.
Family and Dependents
- Spouse (E-21) and unmarried children under 21 (E-22) can accompany EB-2 visa holders.
- Spouse can apply for Employment Authorization Document (EAD).
